Filip Reyntjens: "L'arrêt de la Cour constitutionnelle ne tient pas la route"

Professeur de droit à l'Université d'Anvers, Filip Reyntjens assure que "l'arrêt de la Cour constitionnelle ne tient pas la route". Pour corroborer son propos, ce spécialiste de l'Afrique des Grands Lacs indique deux raisons principales: "tout d'abord  la Cour insiste beaucoup sur l'importance de l'Accord d'Arusha comme source d'inspiration de la Constitution de 2005, mais dans son arrêt elle abandonne toute reference à cet Accord et fait dire à la Constitution tout le contraire de ce que dit l'Accord d'Arusha". Deuxièmement, "l'interprétation d'un passage de l'article 302 de la Constitution est tout à fait erroné. Cet article porte exclusivement sur le mode d'élections du premier president de la période post-transition, alors que dans son arrêt la Cour fait reference aux nombres de mandats, ce qui est totalement faux". Enfin, Filip Reyntjens soutient que "aussi bien à l'étranger qu'au Burundi, on a voulu lire la Constitution à la lumière de l'Accord d'Arusha, alors que ce n'est pas nécessaire car cette Constitution est extremement claire. Le président peut server deux mandats, pas plus".

Nkurunziza's opponents say he is violating the constitution and a peace deal that ended a protracted civil war in 2005 by seeking a third term. The president cites a constitutional court ruling saying he can run. A parliamentary vote will now take place on June 26, followed by a presidential election on July 15. Two out of five CENI committee members resigned after the crisis erupted, including CENI's vice president who fled the country late last month. The appointments announced on Saturday mean the committee has five members again. The opposition, which boycotted the reappointment process, had argued that the commission was illegitimate with only three of its five members. In a statement released on Friday, opposition leaders said CENI's role of "ensuring credible, transparent and democratic elections" was not possible as long as the commission was being run only by those loyal to Nkurunziza. Dr Karemera wamuritse iyi raporo, yagize ati, "Duhitamo abo tubaza (sampling) twarebye ibice byose by'abanyamuryango harimo urubyiruko, abagore, abikorera, abayobozi bakiri bato, abanyeshuri n'abanyarwanda baba mu mahanga."

By'umwihariko twarebye kuri manda za Perezida wa Repubulika, tureba ku bwoko bwa za guverinoma bushoboka, dukora isesengura ku bibazo u Rwanda ruhura na byo, tureba no hirya no hino. Aha Dr Karemera yakomozaga ku byo Perezida Kagame yari amaze kuvuga, aho yanenze mu buryo buziguye Amerika iherutse kuvuga ko u Rwanda rukeneye inzego zikomeye aho kuba abantu bakomeye, bityo ikaba idashyigikiye ko Kagame yongera kwiyamamaza.

Yagize ati, "Iyo mubona uburyo Umuryango Mpuzamahanga ukingira ikibaba FDLR hari icyo bigomba kutubwira nk'abashinzwe gutegura mu buryo buhamye ahazaza h'iki gihugu.

Hari ibitangazamakuru bipfobya bikanahakana Jenoside, ukareba inkiko zirekura ku bushake abahekuye u Rwanda kugira ngo zikomeze zihe uruvugiro FDLR…."

Nyuma yo gusuzuma ibyo bibazo, abanyamuryango ba RPF ngo baravuze bati, "Ariko se ubundi niba Perezida Kagame yarashoboye kudukura muri biriya bihe (bya Jenoside yakorewe Abatutsi), aho igihugu cyari gisa n'ikitakiriho, kuba Umunyarwanda ari igisebo, ubu tukaba turi igihugu gikomeye, kuki tutakomezanya na we?"

Bemeza kandi ko "u Rwanda rufite sosiyete ijegajega (fragile) ikeneye umuyobozi ukomeye, ari we Perezida Kagame, we mizero y'umutekano," nk'uko Senateri Karemera yakomeje abivuga.

Umukuru w'Igihugu yavuze ko mu byo yatumye abayobozi, guhatira abaturage gusinya ko bashaka manda ya gatatu ye, bitarimo, ndetse ko byaba bigayitse niba koko hari ababihatirwa.

Ibi yabivuze ahereye ku byo abona mu itangazamakuru kuri iyi ngingo. "Barabanza bakandika bavuga ko Kagame ashaka manda ya gatatu, bagakomeza bavuga ko 2/5 by'Abanyarwanda bamaze kwandika bavuga ko bamushaka.

Ariko muri ibyo 2/5 bakavuga ko hari abashyirwa ku gahato ngo basinye. N'ejo narabibonye kuri Televiziyo y'Abafaransa, umuntu yababwiraga bamuhishe mu maso, avuga ko na we bamukoreshejeho igitugu kugira ngo asinye. Niba byarabaye nzabigiraho ikibazo, namwe mukwiye kubigiraho ikibazo."

Kuri iyi ngingo, yo kuba haba hari abahatirwa gusaba ko Ingingo ya 101 y'Itegeko Nshinga ivugururwa, Dr Karemera yabaye nk'uhumuriza Perezida Kagame, amubwira ko abavuga ibyo bakabya, ati "nubwo hari abavuga ko habayemo gutekinika, simpamya ko watekinika kuri urwo rwego"
