COMMUNIQUE DE PRESSE

 Les Forces Démocratiques Unifiées (FDU Inkingi), parti politique d'opposition au régime du Front Patriotique Rwandais (FPR) au pouvoir en place, portent à la connaissance du public que l'Etat Rwandais ne s'est pas présenté ce mercredi 22 mars 2017 au procès que lui avait intenté Madame Victoire INGABIRE UMUHOZA, présidente des FDU INKINGI et prisonnière politique au Rwanda, dans l'Affaire n°003/2014 en cours devant la Cour Africaine des Droits de l'Homme et des Peuples, à Arusha en Tanzanie.

Les raisons invoquées par le gouvernement rwandais dans une lettre adressée à la CADHP mettent en cause l'impartialité de cette Cour liée à ses sources de financements. L'Etat rwandais accuse les bailleurs de fond de la Cour Africaine, à savoir l'USAID (United States Agency for International Development), la GTZ  (German Technical Cooperation Agency) et FIDH (Fédération Internationale des Ligues des Droits de l'Homme) entre autres, d'avoir corrompu le Greffier et les Juges auprès de la Cour, pour qu'ils acceptent les requêtes de la défense aux fins de condamner l'Etat rwandais pour crime de violation des droits de l'homme.

Le gouvernement rwandais prétend, en outre, qu'il y a eu rectification de l'arrêt de la Cour du 3 juin 2016 portant décision de la poursuite des débats pour les affaires pendantes devant la Cour. Or, la rectification dont il est question ne concerne que des erreurs de frappe qui ont été corrigées.

Une autre raison invoquée pour justifier l'abandon du procès est, selon l'Etat Rwandais, le manque d'indépendance et d'impartialité de la Cour au motif que la Cour aurait accepté les requêtes de la défense.

Au cours de l'audience du 4 mars 2016, la défense avait introduit quatre requêtes, à savoir :

1. Une requête demandant le rejet des arguments exposés par la CNLG pour justifier la qualité d'Amicus curiae ;
2. Une requête pour ordonner à l'Etat Rwandais de faciliter l'accès des avocats de la défense à leur cliente ;
3. Une requête pour ordonner à l'Etat rwandais de prendre les dispositions utiles pour que Madame Victoire Ingabire Umuhoza puisse suivre son procès par Vidéoconférence ;
4. Une requête pour demander à l'Etat Rwandais de se conformer aux directives de la Cour notamment en ce qui concerne sa décision du 7/10/2015 portant sur le dépôt des documents pertinents.

La Cour a infirmé les 1^ère et 3^ème requêtes et validé les 2ième et 4ième.

 

Malgré l'absence de l'Etat rwandais, l'audience a bien eu lieu. Elle s'est tenue dans un climat serein. Plusieurs questions ont été posées par la Cour dont certaines concernent particulièrement la procédure de révision des jugements au Rwanda. Après la clôture des débats, les parties doivent déposer leurs conclusions, et l'Affaire mise en délibérée.

 

Les FDU trouvent que le retrait intempestif est injustifié et montre le vrai visage du régime de Kigali. En effet, le régime de Paul Kagame n'accepte que sa propre justice ô combien partiale et inéquitable. Lorsque les bailleurs de fonds financent sa justice, personne n'a rien à y redire et ces financements semblent devenir une preuve de crédibilité ; mais quand les mêmes bailleurs financent d'autres Cours sur lesquels le FPR n'a pas la mainmise, ceci devient synonyme de corruption.

Les organisations internationales de droit de l'homme comme Amnesty, HRWd'une part et l'Union Européenne d'autre part, n'ont jamais cessé de dénoncer le procès politique dont Mme Victoire Ingabire  avait été victime.

Nous demandons aux pays bailleurs de fonds du gouvernement du FPR de faire pression pour que la Présidente des FDU-Inkingi, Mme Victoire Ingabire Umuhoza, soit libérée sans conditions.

The Unified Democratic Forces (FDU Inkingi), a political party opposed to the regime of the ruling Rwandan Patriotic Front (RPF), would like to inform the public that the Rwandan state did not show up on Wednesday 22 March 2017 at the African Court on Human and Peoples' Rights in Arusha, Tanzania, to defend itself in the appeal case No. 003/2014 brought against it by political prisoner Mrs. Victoire Ingabire Umuhoza.

The reasons given by the Rwandan government in a letter to the ACHPR, include lack of impartiality of the Court  due to the sources of its funding.  The Rwandan government accuses the funders of the African Court for Human and Peoples' Rights, namely USAID (United States Agency for International Development), the German Technical Cooperation Agency (GTZ) and FIDH (the International Federation of Human Rights League), of having bribed the Registrar and the Judges of the Court, on account of having accepted the defendant's appeal application. It considers this acceptance to be a ploy to get the  Rwandan State accused of committing the crime of human rights violations.

The Rwandan Government further alleges that the Court's judgment of June 3, 2016 which ruled that  proceedings in the cases pending before the Court would continue, was changed. However, the only changes made relate to typing errors which have been corrected.

Another reason brought forward to withdraw from the appeal case is that, according to the Rwandan State, there is a  lack of independence and of impartiality on the part of the Court because the Court has accepted the defense's requests.

At the hearing on March 4, 2016, the defense filed four applications, namely:

1. A motion requesting the dismissal of the arguments put forward by the CNLG to justify the status of Amicus curiae;
2. A motion to order the Rwandan state to facilitate access of defense lawyers to their client;
3. A motion to order the Rwandan State to take the necessary steps to ensure that Victoire Ingabire Umuhoza follows her trial by videoconference;
4. A motion to ask the Rwandan State to comply with the Court's directives, regarding its decision of 7.10.2015 on the tabling of the relevant documents.

The Court rejected the first and third applications and accepted the second and fourth applications.

The hearing took place in the absence of a representative of the Rwanda government. It took place in a calm atmosphere. Many questions were asked by the court particularly with regard to procedures followed in Rwanda in reviewing court rulings. After closing court deliberations, the parties will submit their concluding remarks. Deliberations on the case will then follow.

The FDU-Inkingi finds this untimely withdrawal unjustified and shows the true face of the Kigali regime. Indeed, the regime of Paul Kagame only accepts its own justice which lacks impartiality and is unfair. The regime has no problem receiving financial aid from donors to fund its justice system and would not want anyone criticize it. This is used to raise its image and credibility. However, when the same donors fund a different court where the RPF has no say then it becomes corruption.

International human rights organizations such as Amnesty, HRW and the European Union as well, have always denounced the politically motivated trial of Mrs. Victoire Ingabire.

We call upon donors to put pressure on the RPF government for unconditional release of the President of the FDU-Inkingi, Victoire Ingabire Umuhoza.
