Rwanda: Sept membres des FDU-Inkingi condamnés à 2 ans de prison pour « avoir rencontré le secrétaire général du parti ».

Kigali, le 11 juillet 2013.
Ce jeudi 11 juillet 2013, le tribunal de première instance de Ruhango dans la région de Rutsiro a condamné 7 membres des FDU INKINGI – Byukusenge Emmanuel, Twizeyimana Valens, Gasengayire Leonille, Ufitamahoro Norbert, Nahimana Marcel, Uwiringiyimana Venuste et  Dukundane Moise- à 2 ans de prison ferme pour avoir rencontré et n'avoir pas dénoncé auprès des autorités, la présence sur les lieux du secrétaire général intérimaire du parti. Invoquant l'article 570 du code pénal, le tribunal estime qu'il était de leur devoir de dénoncer la présence d'un membre de l'opposition démocratique, comme si c'est en soi un crime.
Les 7 membres du parti ont été arrêtés le 15 septembre 2012 vers 20 heures du soir par les membres de l'armée qui les ont scandaleusement tabassés pour n'avoir pas rapporté auprès de ses services la présence de Sylvain Sibomana, secrétaire général intérimaire du parti, qui ne faisait l'objet d'aucun mandat de recherche. L'armée leur a reproché de complicité avec quelqu'un qui propage des rumeurs destinées à aliéner la population contre le régime, infraction punie selon eux par l'article 463 du code pénal.
Lors de l'audience de fond qui a eu lieu le 24 mai 2013, les accusés tout comme leur conseil maître Anastase Mutagoma,  avaient plaidé non coupable, estimant qu'il n'y avait pas eu d'infraction. En effet, sur base des articles 35&36 de la constitution rwandaise, ils n'avaient pas besoin d'autorisation pour se  rencontrer dans un café et parler des affaires de leur parti.
Entre temps, Sylvain Sibomana et Anselme Mutuyimana, qui sont co-accusés dans cette affaire, ont quant eux comparu devant la haute cour de Karongi pour plaider le fond.
Les deux membres du parti comparaissaient devant une juridiction supérieure sur base des fonctions qu'ils occupent dans le parti, selon une décision de justice rendue antérieurement. Ils sont accusés de propagation de rumeurs destinées à aliéner la population contre le régime contrairement à l'article 463 du code pénal.
Le ministère public leur reproche d'avoir, au cours de leur rencontre, dénigré certains projets de l'Etat, tel que le fonds Agaciro, les mutuelles, la répartition territoriale des projets de développement, ainsi que l'enseignement. Anselme est considéré comme coauteur, par ce que c'est lui qui représente le parti dans la circonscription dans laquelle a eu lieu la rencontre. Les accusés ont dit à la cour qu'ils n'ont violé aucune disposition de la constitution, conformément aux articles 33 et 53. Mr. Sibomana Sylvain a déclaré au juge qu'il ne voyait absolument pas d'infraction pour un parti non encore enregistré, à aller à la rencontre des militants, pour réunir les conditions posées par les autorités pour avoir une reconnaissance officielle. Qu'il soit poursuivi pour cela est plutôt pathétique, dans un état qui se dit de droit.
Dans son réquisitoire, le ministère public a réclamé 15 ans contre les deux accuses. Quant aux deux conseils de  la défense,  maîtres Claude Munezero et Bimenyimana Emmanuel, ils ont plaidé l'acquittement pure et simple par ce qu'il n y a pas eu d'infraction du tout. Le jugement sera rendu le 12 août 2013.
Ce 12 juillet 2013, Sylvain Sibomana doit comparaître dans un autre procès devant la haute cour de Gasabo en compagnie de Dominique Shyirambere pour entendre le verdict . Ils sont accusés d'avoir organisé une manifestation non autorisée lors de l'ouverture devant la cour suprême, du procès en appel de madame Victoire Ingabire, prisonnière politique et présidente du parti. Ce qui est pure fabrication. Le ministère public a réclamé 7 ans de prison pour Sylvain et 2 ans de prison pour Dominique.
Les procès intentés injustement contre des membres de l'opposition démocratique au régime du président Kagame, ainsi que les très lourds verdicts qui sont prononcés, sont la preuve que le régime n'est pas du tout prêt à ouvrir l'espace politique. Que l'appareil judiciaire obéisse à cet agenda du régime démontre le manque d'indépendance de la justice au Rwanda.
Le parti FDU INKINGI ne se lassera jamais d'aider la population  à réclamer ses droits à la liberté d'expression et de pensée. Il rappelle aussi que la mise en prison de toute opinion divergente ne résoudra pas les problèmes auxquels font face les rwandais.

FDLR Splinter Group Commander Killed by Rwandan Defense Forces Special Forces

Soki Sangano Musuhuke, a commander of FDLR splinter group, known as FDLR-SOKI, was killed last night in Busanza, Rutshuru, North-Kivu,  by Rwandan Defense Forces(RDF) Special Forces embedded within M23 Congolese rebels. He was killed along with 9 of his bodyguards.

Soki deserted FDLR-FOCA in 2005 following a conflict with FDLR Commander, General Mudacumura, and formed his own group. He was operating on the shores of Lake Edward and in northern Rutshuru. His forces included between 150 and 300 combatants.

Tricked into Cooperation with M23 Congolese Rebels.
According to sources within Soki's group, Soki and his 9 bodyguards were killed while on their way to a meeting with a delegation of M23 Congolese. In recent weeks, he had been contacted by M23 rebels commanders, through ex-CNDP soldiers who had joined Soki's group and was proposed a collaboration in return of a supply of weapons and ammunitions. He agreed to meet with M23 rebels commanders supposedly to discuss the terms of their collaboration and to take possession of arms and equipment supplies. What he did not know, was that the setup was coordinated by RDF special forces embedded within M23 rebels, and who are the real operational commanders of M23 troops(Invigorated by Recent Successes Against Rwandan Defense Forces, Rwandan Rebels Close in to Rwandan Border).  The RDF Sepcial forces ambushed him around 11:00 PM on Tuesday and after heavy battles and bombardment, he was killed.

Hundreds of Troops without a Commander.
Now, the question remains of what will become of his hundreds of troops. According to independent observers and sources in Kivu, Soki led an armed group engaged in regular and often large-scale looting activities and had no specific political agenda. He at one time or another allied himself with several Mai-Mai groups fighting M23 or CNDP rebels supported by the Rwandan government and military leaders  and on other occasions allied himself with CNDP and M23 rebels. He was also allied with Major Gaheza who allegedly was captured inside Rwanda and accused of working with Rwandan Defense Forces dissidents based in South Africa, General Kayumba Nyamwasa and Colonel Patrick Karegeya.
Eventually, it was found that Colonel Gaheza and Colonel Soki were rather being used by Rwandan Department of Military Intelligence (DMI) to try to frame General Kayumba Nyamwasa and Colonel Patrick Karegeya (see Rwandan Rebel Officers from an Offshoot Group Surrender of June 22, 2011)
