Aujourd'hui, j'aimerais annoncer ma décision de réactiver nos enquêtes en République Démocratique du Congo (« RDC »). Ces enquêtes porteront en priorité sur les crimes présumés relevant du Statut de Rome commis dans la province du Nord-Kivu depuis janvier 2022.

Les autorités de la RDC ont à deux reprises saisi mon Bureau de renvois aux fins  d'initier des enquêtes sur leur territoire. Le premier renvoi, soumis  le 3 mars 2004, portait sur des crimes présumés relevant du Statut de Rome commis sur l'ensemble du territoire de la RDC depuis le 1er juillet 2002. En juin 2004, mon Bureau a ouvert une enquête sur la situation en RDC. Le Gouvernement de la RDC a soumis un second renvoi le 23 mai 2023 concernant des crimes présumés commis dans la province du Nord-Kivu par des membres de différents groupes et forces armés depuis le 1er janvier 2022.

Au cours des derniers mois, mon Bureau a évalué, à titre préliminaire, si les crimes présumés relevant du Statut de Rome commis dans la province du Nord-Kivu depuis janvier 2022 sont suffisamment liés à la portée de la situation faisant l'objet d'une enquête déjà ouverte en RDC.

Cette évaluation est arrivée à son terme. J'ai déterminé que les derniers épisodes de violence dans la province du Nord-Kivu sont liés à des schémas récurrents de violence et d'hostilités qui sévissent dans la région depuis au moins le 1er juillet 2002, date à  laquelle la Cour a commencé à exercer sa compétence en RDC. Par conséquent, tous les crimes présumés relevant du Statut de Rome commis dans la province du Nord-Kivu depuis le 1er janvier 2022 relèveraient de l'enquête en cours ouverte en juin 2004.

Je tiens à rappeler que nos enquêtes dans la province du Nord-Kivu ne se limiteront pas à des parties au conflit en particulier, ou à des membres de groupes spécifiques. Au contraire, mon Bureau examinera de manière globale, indépendante, et impartiale la responsabilité de tous les auteurs présumés ayant commis des crimes relevant du Statut de Rome. Aussi, mon Bureau accordera une attention particulière au principe de complémentarité et recherchera la collaboration et la coopération des autorités nationales et de celles de tous les acteurs pertinents en vue d'assurer une justice efficace pour les victimes des crimes en question.

Le Mémorandum d'entente conclu en juin 2023 entre mon Bureau et la RDC, et la récente mission de mise en œuvre de cet instrument, conduite par le Procureur adjoint Mame Mandiaye Niang, ont fourni un cadre renforcé de collaboration et de dialogue, alors que nous définissons une approche à deux voies marquée par la vigilance et le partenariat, avec une enquête en cours, d'une part, et des efforts pour soutenir la justice nationale, d'autre part.

Comme rappelé dans la Politique générale du Bureau relative à la complémentarité et à la coopération, la fin des cycles d'impunité en RDC ne peut être envisagée que par des efforts conjoints de la RDC, de mon Bureau, et de la communauté internationale dans son ensemble en faveur de la justice pénale.

Notre objectif ultime est une stratégie de justice transitionnelle à long terme, durable et viable en RDC, que la CPI et la communauté internationale peuvent à la fois soutenir et s'en inspirer. Je salue à cet effet la décision prise par les autorités congolaises de mettre en place un comité de pilotage pour travailler à l'établissement d'une Cour pénale spéciale pour la RDC. Conformément au principe de complémentarité, mon Bureau se tient prêt à apporter une assistance technique à la RDC pour la création de ce mécanisme et pour renforcer sa collaboration et sa coopération avec les autorités nationales et les partenaires concernés en vue d'accroître l'impact de nos actions collectives dans la lutte contre l'impunité des crimes internationaux.

Today, I wish to announce that I have decided to renew our investigative efforts in the Democratic Republic of the Congo ("DRC"). Priority focus of the investigation will be given to any alleged Rome Statute crimes occurring in North Kivu since January 2022.

The DRC authorities have twice seized my Office to undertake investigations into the situation in their territory. Their first referral, submitted on 3 March 2004, encompassed alleged Rome Statute crimes committed in the entire territory of the DRC since 1 July 2002. In June 2004, the Office opened an investigation into the situation in DRC. The DRC government submitted a second referral on 23 May 2023 concerning alleged crimes committed in North Kivu by members of different armed groups and forces since 1 January 2022.

In the past months, my Office assessed, as a preliminary matter, whether any Rome Statute crimes committed in North Kivu since January 2022 are sufficiently linked to the scope of the existing situation under investigation by my Office in the DRC.

This assessment is now complete. I have determined that the latest episodes of violence in North Kivu since 2022 are interconnected with patterns of violence and hostilities that have plagued the region since at least 1 July 2002, the start of the Court's jurisdiction in the DRC. Therefore, any alleged Rome Statute crimes committed in North Kivu since 1 January 2022 would fall within the remit of the ongoing investigation opened in June 2004.

I wish to recall that our investigations in North Kivu will not be limited to particular parties or members of specific groups. Rather, my Office will examine holistically, independently and impartially the responsibility of all actors allegedly committing Rome Statute crimes. My Office will also pay close heed to the principle of complementarity and seek engagement and cooperation from  national authorities and all relevant actors with a view to ensuring effective justice for the victims of the crimes concerned.

The Memorandum of Understanding concluded in June 2023 between my Office and the DRC, and the more recent implementation mission led by Deputy Prosecutor Mame Mandiaye Niang, have provided an enhanced framework for collaboration and dialogue as we chart a two-track approach marked by vigilance and partnership, with an ongoing investigation on the one hand and efforts to support domestic accountability on the other. As the Office's Policy on Complementarity and Cooperation emphasises, ending the cycles of impunity in the DRC can only be achieved through joint accountability efforts by the DRC, my Office, and the wider international community.

Our ultimate goal is a long-term, sustainable and viable transitional justice strategy in the DRC, which the ICC and the international community can both support and learn from. To this effect, I welcome the decision taken by the DRC authorities to set up a steering committee to work on the establishment of a special criminal court for the DRC. In line with the complementarity principle, my Office stands ready to provide technical assistance to the DRC in the creation of this mechanism and to deepen collaboration and cooperation with national authorities and relevant partners, as we seek to increase the impact of our collective actions in the fight against impunity for international crimes.

YAOUNDE, Oct 11 (Reuters) - Cameroon has outlawed any discussion about the health of 91-year-old President Paul Biya, a letter shared by the interior ministry said, after Biya's prolonged absence fuelled widespread speculation he was unwell.

Earlier this week, the authorities put out statements saying the president was on a private visit to Geneva and in good health, dismissing reports he had fallen ill as "pure fantasy".

In the letter to regional governors dated Oct. 9, Interior Minister Paul Atanga Nji said discussing the president's health was a matter of national security.

From now on, "any debate in the media about the president's condition is therefore strictly prohibited. Offenders will face the full force of the law", Nji said.

He ordered the governors to set up units to monitor broadcasts on private media channels, as well as social networks.

Cocoa and oil-producing Cameroon, which has had just two presidents since independence from France and Britain in the early 1960s, is likely to face a messy succession crisis if Biya became too ill to remain in office or died.

Cameroon's media regulator, the National Communication Council, could not immediately be reached for comment.

The move faced criticism as an act of state censorship.

"The president is elected by Cameroonians and it's just normal that they worry about his whereabouts," said Hycenth Chia, a Yaounde-based journalist and talk show host on privately owned television Canal2 International.

"We see liberal discussions on the health of Joe Biden and other world leaders, but here it is a taboo," he told Reuters.

Press freedom advocacy group Committee to Protect Journalists said it was gravely concerned.

"Trying to hide behind national security on such a major issue of national importance is outrageous," said Angela Quintal, head of the CPJ's Africa Program.

Biya has not been seen in public since attending a China-Africa forum in Beijing in early September. His failure to appear as scheduled at a summit in France last weekend further stoked public discussion about his health.
