Uganda: Two more Rwandan fugitives 'disappear'

It is suspected that they were kidnapped and taken back to Rwanda
where they are wanted for trial by the Kigali government.

Two Rwandan dissidents who had been granted refugee status in Uganda
have mysteriously disappeared, sparking suspicion that they could have
been kidnapped and taken back to Rwanda where they are wanted for
trial by the government.

Mr Charles Sande, a captain in Rwandan Defence Forces and former
military signaler of Defence Minister Gen James Kabareebe and Mr
Christopher Busigo, who was a pastor in Rwanda, went missing on
Monday.
Mr Sande's wife told Saturday Monitor that her husband left home
saying he was going to meet a friend in town but never returned.

"He was always living in hiding because of harassment from the Rwandan
intelligence operatives who were trailing him. His phones have been
off since then," she said.

Mr Sande and Mr Busigo are reported to be among the seven refugees the
Rwanda government wanted extradited to Kigali to stand trial for
crimes they allegedly committed before they fled the country. Their
lawyer, Mr Ladislus Rwakafuzi, said yesterday that the two Rwandan
nationals had told him they feared for their lives.

Mr Sande and Mr Busigo have been friends and were always moving
together. Two week ago, the UNHCR in Geneva protested the request by
Rwanda to have the refugees extradited. When contacted, the Rwandan
Ambassador in Uganda, Maj Gen Frank Mugambagye, said he could not
discuss issues of refugees on phone.

Rwanda: à son procès, Simbikangwa affiche la thèse du double génocide

L'ex-capitaine rwandais Pascal Simbikangwa a reconnu vendredi lors de son procès historique à Paris le génocide des Tutsi au Rwanda pour lequel il accusé de complicité, tout en affirmant qu'il ne pouvait "effacer le génocide hutu, beaucoup plus étendu".

Le président Olivier Leurent a pour la première fois depuis l'ouverture mardi de ce procès devant les assises de Paris posé à l'accusé la question de savoir s'il reconnaissait le génocide qui a fit 800.000 morts entre avril et juillet 1994, essentiellement parmi la minorité tutsi mais aussi parmi les opposants hutu au régime extrémiste hutu de l'époque.

"Le génocide des Tutsi est réel et incontestable, mais il ne peut effacer le génocide (des) Hutu, beaucoup plus étendu", a déclaré Pascal Simbikangwa.

Il faisait référence aux violences et massacres, documentés par des ONG internationales, qui ont suivi le génocide, notamment dans l'est du Zaïre (aujourd'hui République démocratique du Congo) où s'étaient réfugiés des Hutu rwandais, parmi lesquels se cachaient des génocidaires, et où est intervenue la nouvelle armée rwandaise issue de la rébellion tutsi qui a pris le pouvoir en mettant fin au génocide.

Négationnisme

Le président lui faisant remarquer que l'historien Stéphane Audouin-Rouzeau qui venait de déposer avait estimé que cette théorie du "double-génocide" relevait du négationnisme, l'ex-capitaine de l'armée et des services de renseignement a déclaré "ne pas partager ce point de vue".

"A ce que je sache, le génocide suppose une volonté d'exterminer une partie ou la totalité d'une population en considération de son ethnie, sa religion ou sa race. Le FPR (Front patriotique rwandais, ex-rébellion tutsi) massacrait les réfugiés et savait qu'ils étaient hutu", a-t-il dit.

"Les Tutsi ont été beaucoup plus massacrés pendant la guerre de 1994, mais le FPR en conquérant le terrain a beaucoup massacré".

Alors que le président lui fait remarquer qu'il semblait douter de la réalité du génocide lors de ses premières déclarations devant le juge d'instruction, M. Simbikangwa explique avoir depuis "fait beaucoup de lectures qui m'ont donné beaucoup de recul".

Il assure avoir vu très peu de violences lui-même. "Pour les Rwandais qui étaient sur place, c'était très difficile de savoir. Par exemple le chef des interahamwe (milice du pouvoir hutu) était un tutsi. (...) Moi j'habitais à Kiyovu (quartier résidentiel) il n'y a pas eu un seul mort".

"Mmmoui, on verra ça", le reprend immédiatement le président. Pascal Simbikangwa est notamment accusé d'avoir organisé et armé les miliciens aux barrages de Kiyovu où étaient filtrés les Tutsi.

Alain Gauthier, président du Collectif des parties civiles pour le Rwanda, a jugé que la reconnaissance du génocide des tutsi était "déjà un point", tout en qualifiant de "minable" le fait pour l'accusé d'affirmer qu'il n'avait pas su ce qui se passait.

"Il vient de reconnaître le génocide tutsi, c'est déjà un point. Mais il revendique un génocide hutu. Les Tutsi ont été exterminés parce qu'il étaient Tutsi, il y avait une volonté étatique. (...) Les morts dans les camps (en RDC) sont malheureusement les morts qu'on trouve dans toute guerre, mais il n'y avait aucune volonté du gouvernement rwandais (issu du FPR) d'exterminer les Hutu", a-t-il estimé.

De son côté, Alexandra Bourgeot, un des avocats de la défense, a déclaré n'avoir "pas apprécié que la question (du président sur la reconnaissance du génocide) intervienne après que l'expert a dit que la notion de double génocide s'apparente à du révisionnisme", jugeant le timing "déloyal".

European Union seeks to stem use of conflict minerals

BRUSSELS, Feb 5 (Reuters) - The EU's trade chief will present a
voluntary scheme in March aimed at stemming the import of minerals
from conflict zones and prevent mining them from financing war and
strife, EU officials said on Wednesday.

Karel De Gucht's proposal to the European Commission, the EU
executive, will encompass gold, tungsten, tantalum and tin, in a bid
to pressure importers to classify them as coming from areas free of
conflict.

"Work is currently underway to prepare a proposal ... for a
comprehensive EU framework on responsible mineral sourcing in line
with international guidelines," said EU Trade spokesman John Clancy.

The United States defines the conflict mineral zone as the Democratic
Republic of Congo and neighboring countries including Angola and South
Sudan. They make up 17 percent of the global production of tantalum, 4
percent of the global production of tin, 3 percent of tungsten and 2
percent of gold.

Tantalum is used in electronics, while tungsten is used in light bulb filaments.

Initially devised to include only the Republic Democratic of Congo, as
U.S. legislation does, the EU's proposal is now likely to be extended
to a range of conflict regions including Myanmar to Afghanistan,
according to officials.

The scheme will not cover diamonds and the proposal will still need to
be approved by EU lawmakers and governments.

The European Union is already part of the 50-member Kimberley Process,
a government, industry and civil society initiative set up in 2002 to
control the use of rough diamonds that fund rebel movements and human
rights abuses.

The European Union, which increasingly requires its trading partners
to make commitments to political and human rights reforms, wants to
introduce a similar scheme for other minerals and make its disclosure
rules binding for importers, although there is still internal debate
on the issue, EU officials said.

The latest draft of De Gucht's proposal envisages only a voluntary
participation in the conflict minerals scheme, according to officials
familiar with the document.

Under the draft plan, shipments of minerals could be accompanied by a
certificate to guarantee that they are conflict-free. Criteria to
define a conflict-free mineral will be defined in detail and will have
to be respected by the companies using the conflict-free label for
their products.

The list of minerals affected by the procedure is also subject to
negotiations and may become longer, or remain open for future
